Farmácia da Penha, Lda, headquartered at Estrada da Penha nº52, 8005-135 Faro, and with commercial registration 505 741 350, is the legitimate owner of the official Love my Pharma website, whose domain is on the site www.lovemypharma.com with the Technical Direction of the Online Store under the responsibility of Dr. Susana Maria Tomé Soares de Andrade Sarraguça.

Object and Scope of Application

All product sales made at Love my Pharma, between the client, as buyer, and Love my Pharma as seller, are governed by the General Terms and Conditions of Sale. Such conditions apply both to visitors and to any commercial transaction carried out through our Online Store;

The search for products, as well as their purchase, is subject to acceptance of the General Terms of Use, defined by Love my Pharma;

Love my Pharma will consider “Client”, “User” or “Buyer” any individual who purchases products or services in the Online Store;

Considering the growing evolution of Online shopping platforms, Love my Pharma may, at any time and without prior notice, change the previously mentioned Terms of Use and Contracting. Under the same conditions, information and commercial offers related to products, prices, commercial conditions, and promotions may be modified. Love my Pharma will always take into account the publication of all changes made;

All orders placed by users who do not agree with the General Terms and Conditions of Sale of the “Seller” (Love my Pharma) may not be considered, and Love my Pharma reserves the right not to process them;

A valid email or postal address must always be provided by the “Customer” that allows the “Seller” (Love my Pharma) to contact the “Customer” whenever appropriate. This contact is previously accepted and authorized by the consumer.

Content provided on Love my Pharma

Any attempt, without prior written authorization, to reproduce, transfer, distribute, and store content or digital materials present on Love my Pharma is prohibited. All content is for strictly personal use;

The introduction of links on our official website for commercial purposes is not allowed without prior authorization. Likewise, the use of the Love my Pharma domain is prohibited, www.lovemypharma.com, by third parties, with the infringement being subject to appeal through the competent legal means by Love my Pharma;

Love my Pharma is not responsible for links outside the official page www.lovemypharma.com, or Social Networks that allow access to the Online Store. Any content posted on those same links will likewise not be the responsibility of Love my Pharma;

The Love my Pharma Communication and Marketing Team prioritizes transparent communication with the “Customer” and works to ensure that all information presented in the online store is free of spelling errors. In the event of any spelling error, it will always be corrected as soon as possible;

The disclosure of contractual information, product and service information, communications (via email or sms) and sales formalizations is officially carried out in European Portuguese and is translated into Spanish and English. Only expressions specific to the universe of medicines and health products that cannot be translated will be presented in a foreign language. Situations where the commercial name of the product in Portugal may not be the same as the commercial name of the product in Spain should be considered. Commercial Policy

The customer will always have the right to terminate the Purchase and Sale contract, under applicable legal terms, if the product or service information presented in the Online Store does not correspond to their characteristics;

Love my Pharma warns that the images shown may be merely illustrative. We therefore recommend always consulting the detailed product information provided in its description. We suggest that, in case of doubt, you contact us or consult the official website of the brand in question;

Any change in the price and characteristics of the product does not require prior notice;

The consumer must be aware of and accept the General Terms and Conditions of Sale of Love my Pharma before validating their purchase or order request;

All data recorded by Love my Pharma serve as proof of the set of transactions carried out between Love my Pharma and the “Customer”. 

Retention of Ownership of marketed products

All products present on Love my Pharma remain the property of Love my Pharma until payment is made by the consumer for their acquisition.

Quality and Guarantee 

Only products sold through the official Love my Pharma page will be marketed. Under no circumstances will second-hand products or products of lower quality than market standards be sold;

Love my Pharma warns that the browsers and monitors used by consumers may influence the aesthetic appearance of the products displayed in the Online Store. For this reason, the products viewed may not fully correspond to the final product.

Prices

All amounts presented on Love my Pharma are already subject to Value Added Tax (VAT);

At the end of the online purchase process, the customer will be presented with a final amount that includes the product price, Value Added Tax, and delivery costs, if applicable. The invoice related to the purchase will be delivered together with the order;

The prices of the products presented on Love my Pharma are listed in Euros, and the only change to the final amount will be based on shipping costs or the application of a promotional discount.

Love my Pharma provides the total price of each product including Value Added Tax (VAT), and cannot be held responsible in case of a computer error or any other cause that results in a substantial unplanned change in the retail price listed on the Love my Pharma website. In cases where this amount is negligible, the order will be canceled even if it was previously accepted or confirmed by the Sales Team. The customer will always be informed of this fact, and Love my Pharma will be exempt from any liability for damages or costs arising from this action.

Responsibility

Love my Pharma shall only be responsible for damages suffered by the “Buyer” if such damages result from breaches attributable to Love my Pharma’s contractual obligations towards the “Consumer,” or if the liability arises from the applicable legal right;

Any damage suffered by the consumer as a result of inappropriate use of the products shall not be the responsibility of Love my Pharma;

Love my Pharma is not responsible for damages resulting from incorrect information on the Online Store or on the product itself;

Love my Pharma guarantees consumers that all products marketed in the Online Store comply with Portuguese and community legislation;

Love my Pharma assumes no responsibility in case of violation of the legislation of the country where the order is delivered. The customer must check with local authorities the conditions of import or use of the products they intend to order.

Intellectual and Industrial Property

All texts, comments, works, and images reproduced or represented on Love my Pharma are strictly reserved under copyright law as well as intellectual property rights, worldwide;

Accordingly and under the terms of the Intellectual Property Code, the use of information for private purposes is only authorized, subject to contrary provisions, including more restrictive provisions contained in the said code;

Any reproduction or representation, total or partial, of Love my Pharma or the elements included therein is strictly prohibited;

The corporate names, trademarks, and distinctive signs reproduced on Love my Pharma are protected under the applicable legal provisions on industrial property. The reproduction or representation of all or part of any distinctive signs is strictly prohibited and must be subject to prior written authorization from the owner of the Love my Pharma trademark;

If the “User” intends to use information or materials from the Online Store, they must obtain prior written authorization granted by Love my Pharma.

Applicable Law

These Terms and Conditions and all arising disputes related to these general conditions, including their validity, the use of the online store www.lovemypharma.com or any purchase on the same shall be governed by Portuguese Law;

In case of dispute regarding the interpretation or execution of these Terms and Conditions, Love my Pharma and the “Buyer” commit to endeavor to obtain an amicable solution, which is fair and appropriate, within a maximum period of 60 (sixty) days from the receipt of the communication addressed for this purpose by any of the parties involved;

In the absence of an amicable solution, under the terms of the previous number, and in case of breach of these Terms and Conditions, both parties agree that the competent court shall be the Civil Court of Faro, with express waiver of any other.
